The University of Texas fraternity ordered to pay $16 million in a wrongful death case will get a new trial.
The fraternity was sued by the parents of Tyler Cross, who fell to his death from an off-campus dorm in 2006.
Judge John Dietz Wednesday granted the fraternity's motion for a new trial, after it presented evidence showing that its failure to respond to the lawsuit was an oversight and not intentional.
A judge originally ordered the payment after Sigma Alpha Epsilon failed to appear in court last month.
A new trial date has not been set yet.
