The lawyers in the Yogurt Shop Murders trial Wednesday were again battling out the details of new DNA evidence.
The murders took the lives of four teenage girls in a North Austin yogurt shop in 1991.
Defense attorneys for Michael Scott and Robert Springsteen said new DNA results exclude their clients.
The attorneys said more than 60 others who might have had a part in the crime have also been excluded, including a boyfriend of one of the victims.
The defense still has testing to be done before trial.
"The state came out and publicly said we know who it is … they have failed completely in that promise to the public because they have absolutely no idea," Springsteen's attorney, Joe James Sawyer, said.
Judge Lynch is hopeful to have this case headed to trial in early January 2009.
The next hearing in the case is set for Oct. 29.
