Defense attorneys for Michael Scott and Robert Springsteen want to introduce new DNA discoveries, but Wednesday a judge told them to remain quiet.
The two are charged with the Yogurt Shop murders, a crime that happened in 1991 when four teenage girls were murdered in a North Austin yogurt shop.
Defense attorneys also asked that the state order DNA tests for about 15 former suspects in the case to be compared with their new results.
The judge denied their request.
The defense argued that the state is withholding the truth.
"One of two things is true when they came out here and say they knew whose DNA it was," Scott's attorney, Joe James Sawyer said. "One of two things happened … either they lied directly to the public or they were wallowing in ignorance and I think both are unacceptable."
The judge set the next pre-trial hearing for September 17.
Initially there had been talks of an October trial date, but it now looks as though it will be set back.
